Its new design is easier to operate with large, easy-to-find buttons, and it has three built-in speakers for improved sound quality. In addition to an upgraded appearance, the Restore 2 has a few additional improvements over the original version. The real focus here are the 20 gorgeous brightness settings to personalize the intensity of your sunrise. The features this device lacks aren’t necessarily helpful for sleep, nor even useful in general. The SmartSleep has five fairly-realistic nature sounds and a few small buttons around the top to set the alarm, get ready for bed, or listen to a built-in FM radio. While you won’t get features like colorful lighting, breathing or meditation exercises, a plethora of soundscapes, or connection with other smart home gadgets from the SmartSleep, you will get basic necessities. The frosted matte plastic produces one of the most realistic wake-up light sunrises (and sunsets), growing from a deep red into a bright, warm white over 30 minutes. The whole issue of sexual mores and sexual violence in India was a subject that was tricky for Behl to face. "I didn't set out to break any taboos, but the subject forced me to do so," he says. In reflecting on this dark subject matter through the story of one disturbed man, Bhel has made a film that has broken many taboos, even if that wasn't the director's intention. ![]() Rape reports have risen, and many more are scared to come forward. In the aftermath of the incident, the Indian parliament introduced stiffer penalties for sexual crimes, but it seems to have made little difference to the crime rates. In 2012, a brutal gang rape and murder of a student on a bus in Delhi ensured India's high sexual violence rates were brought to the world's attention. Although the film doesn't try to look at the broader picture of sexual violence in India, the subtext is that men's sexual immaturity is one of the drivers making India "one of the most dangerous places to be a woman", as a 2021 Guardian report suggested. "There was this sexual repression that I had felt growing up as a boy in northern India, and not just me, I had seen so many people struggling with the delayed sexual maturity," Behl adds.īehl's film examines the problem of sexual repression, and suggests that it is connected to India's especially high sexual violence rates. "The film looks at certain secret spaces in everybody's lives, which no one wants to talk about," says the 42-year-old director. It's shocking and, at times, unbearable to watch as the Indian director tries to take the spectator inside the dangerous mind of a very sick man fantasising about overpowering women and asserting his masculinity. While this scene has an air of the absurd, Behl doesn't shy away from showing some of Guru's more angry and violent fantasies. It's a bold film where the first sex scene ends with a woman turning into a giant rodent, and we begin to realise that Guru is a fantasist. There is a touch of American Psycho's Patrick Bateman in how Guru's obsessions and delusions blur fact and fiction. Wildly frustrated, Guru spends his days addicted to dating apps and acts out a series of violent sexual fantasies, though Behl never makes clear whether these are real events, or figments of Guru's imagination. There is no space for him to have a partner or a sex life without everyone in his cramped household knowing and commenting, so he wants to have an extension built. There is the much more popular Bollywood version of Indian cinema, which a lot more people know about, and there is also the parallel independent film world where a lot of interesting work has happened, not just now or in the past 5 or 10 years, but over decades.Īgra tells the story of a repressed call centre employee named Guru, who lives in a small house with his parents and married siblings. One of the things Indian cinema is known for all around the world, as well as song-and-dance numbers, is its chasteness, as a result of popular Bollywood productions, which historically didn't even allow for kissing on screen, let alone sex scenes. ![]() ![]() ![]() It stores a true/false value, indicating whether this was the first time Hotjar saw this user. The safer approach, however, may be to reduce continuous production volumes. In summary, it is likely that producing intermittently with no cessation of longer than the period described in the cessation of production clause would be permissible. If an operator temporarily halts or reduces production, it is critical that it do so for the purpose of making a profit and not merely for speculation. And, when a lease has a defined cessation of production clause, that period has been held to be the definitive period of permissible temporary cessation. While production is required to maintain an oil and gas lease beyond its primary term, a reasonable temporary cessation is permissible when there is no cessation of production clause. And, the operator should be prepared to show that it acted as a reasonable and prudent operator would have acted under similar circumstances.ĭuring times of low commodity prices operators often consider reducing or temporarily halting production to reduce losses. If challenged, a court should review profitability over a long term, not just during a few months of low prices. The Court stated that “there can be no limit as to time, whether it be days, weeks, or months, to be taken into consideration in determining the question of whether paying production from the lease has ceased.” Id at 483. The Texas Supreme Court held that an instruction limiting the jury to consider “fifteen months of slowed production” was in error, because it “did not allow the jury to consider the well’s return to profitability following that window.” Laddex at 484. One Texas Court considered 12 months and 21 months to be reasonable considering the facts of the case. ![]() The time period for determining whether a well has produced in paying quantities is “a reasonable period of time under the circumstances.” BP Am. The second prong broadly considers factors such as depletion of the reservoir, price of the produced product, relative profitableness of other wells in the area, operating and marketing costs, net profit, lease provisions, whether the lessee is holding the lease merely for speculative purposes, and whether there is a reasonable basis for the expectation of profitable returns. The first prong considers whether the entire income attributable to the working interest created by the original lease exceeds the operating and marketing expenses, which include taxes, overhead charges, labor, repairs, and depreciation on salvageable equipment, but not costs or expenses in connection with the original drilling of the well. And second, it looks to “whether or not under all the relevant circumstances a reasonably prudent operator would, for the purpose of making a profit and not merely for speculation, continue to operate a well in the manner in which the well in question was operated.” Clifton v. Whether a well has produced in paying quantities is determined in hindsight by considering a two pronged test that first looks to whether the well “pays a profit, even small, over operating expenses … though it may never repay its costs, and the enterprise as a whole may prove unprofitable.” Id. Therefore, in addition to actual production, a lessee must produce in paying quantities to maintain an oil and gas lease beyond its primary term. Texas and New Mexico Courts have held that “the terms ‘produced’ and ‘produced in paying quantities’ mean substantially the same thing.” Id. Oil and gas leases are typically for a certain term of years and then for “so long as oil or gas is produced from the land.” Maralex Res., Inc. ![]() This brief note discusses production in paying quantities, which is often the issue determining the need to invoke one or more lease savings clauses. On Wednesday, Swanson made his major-league debut for Atlanta. This season Miller, when not injured, has pitched to a 7.14 ERA for Arizona, while the shortstop Swanson, the top overall pick in 2015, has emerged as one of the top prospects in baseball. As well, Stewart orchestrated the thus far disastrous December 2015 trade that saw, most notably, Dansby Swanson go to the Braves in exchange for Shelby Miller. Stewart was hired near the end of the 2014 season, and in his near two full seasons on the job the Diamondbacks are a combined 24 games under. Without question, Stewart has not enjoyed much success while in the GM's chair in Arizona. Heyman's piece also includes some quotes from Stewart himself. Stewart's own option comes up at the end of the month (though they could conceivably wait until the end of the season, too), and while it's unusual for a GM to be on the hot seat after only two short years, the D-Backs are a team that's shown to be unafraid of change, so perhaps anything's possible. Here's what Heyman writes in Today's Knuckleball: The front office, which is packed with big achievers and bigger personalities, is predictably not taking this well.
